Cookies Policy

This Policy applies to www.imd.org and other online assets including mobile applications, online correspondence, branded pages on third-party platforms and applications accessed or used through such websites or platforms (hereafter referred to as Online Platforms), which are operated by or on behalf of IMD – International Institute for Management Development, its affiliates and representations in Switzerland and in the world (hereafter referred to as “IMD” or “we” or “our” or “us”).

Our Online Platforms use cookies and similar tools to improve their performance and enhance your user experience. A cookie is a small text file that is stored in your web browser that allows us or a third-party to (1) enable certain functions, (2) provide analytics and (3) store your preferences to speed up your future activities and improve your user experience.

By using our Online Platforms, you are opting in to agree with the provisions of this Policy. If you would like to opt-out, please update your browser’s settings accordingly, but keep in mind that it may negatively affect your user experience.

Some cookies may store personal data, for example if you click “remember me” when logging in. Most of our cookies, however, will not collect data that identifies you and will instead collect general information, such as the name of the website from which the cookie came from, its “lifetime” (i.e. how long it will remain on your device) and a value, which typically is a random number.

What type of cookies we use

Cookies can either be session or persistent cookies. A session cookie expires automatically when you close your browser. A persistent cookie will remain until it expires (as set in the cookie itself) or you delete it.

IMD cookies can be classified as follows:

How do third-parties use cookies on the IMD Online Platforms?

Some third-party companies (e.g. Google Analytics) generally use cookies to collect user data on an anonymous basis. In particular, when you use interactive digital tools offered by IMD (such as self-reflection interfaces or guided input systems) your personal inputs may, on a limited basis, be used to improve the performance and relevance of those tools. Such processing shall always be conducted without profiling, and solely under IMD’s legitimate interest to enhance user experience and system functionality.

5)  Sharing of personal data and international transfers

As mentioned under par. 4 above, for each category of processing operations, some of your personal data may, under limited circumstances, be disclosed and shared with third parties.

In addition to the third parties mentioned above, such sharing may also be made with processors and subcontractors who support IMD in performing its services. This is especially the case for the various software used in the context of IMD’s courses and programs to offer you the best and most complete experience in this context, as well as for the continuous improvement of our online services and learning experience. A list of such processors and subcontractors may be made available on request. It is also the case for part of the hosting of our IT environment.

In any case of transfer of some of your personal data to third parties and processors, any such recipients are contractually prohibited from using or sharing further such personal data for any other purpose than what is contractually provided.

From a geographical point of view, IMD favors whenever possible processors and hosting facilities located in Switzerland and/or the EEA (for its general personal data). Whenever this is not possible, and such recipients are in a country that does not offer adequate data protection legislation, IMD performs a prior data transfer impact assessment (DTIA) that includes the analysis of alternatives existing in an adequately protected country. Whenever this last possibility is not available, and the transfer has to be made, IMD applies additional safeguards with each recipient, which include inter alia (i) the obligation for the recipient to answer a detailed questionnaire on IT security and data protection, (ii) the signing of Standard Contractual Clauses (SCCs), or the use of another safeguard mechanism that is compliant with applicable law, as well as (iii) the regular review and updating of these mechanisms.

For IMD Affiliates in China and Singapore, dedicated copies and hosting requirements for personal data may apply, as provided in the applicable specific privacy notice.

Please note that, aside from the above, IMD may also communicate personal data to third parties when we are ordered or obliged to do so because of a court order, governmental authority, and/or by law. In such a situation, IMD shall implement the required means to limit as much as possible the transfer of personal data. You shall also be informed of this unless applicable law prohibits us from doing so.

Should you have any questions on the above, require any further information, and/or wish to receive a copy of the additional safeguards that apply, please contact us directly.

6) Security, internet security, and integrity

Considering the absolute importance of security applied to personal data, IMD is certified ISO 27001 and ISO 27701. In compliance with these two certifications, we take high-end precautions to protect personal data in our possession from loss and misuse as well as unauthorized access, disclosure, alteration, and destruction. We also maintain physical, electronic, and procedural safeguards that comply with applicable laws to safeguard personal data.

At IMD, we make every effort to follow industry-standard security. However, no data transmitted through the internet and/or stored on servers is 100% secure. Upon submission, your application will be reviewed to ensure alignment with your objectives and profile. If accepted, you will receive an acceptance letter electronically, along with an invoice where applicable, confirming your Enrolment. A program coordinator will provide pre-program details.

1.5. Insurance

If applicable, you hereby confirm and agree that you will maintain, at your own expense, valid and adequate health and accident insurance coverage for the entire duration of your participation in the Program. This insurance must cover you while you are in Switzerland and/or in any other countries where the Program is conducted.

1.6. Application content

Should any elements of information and/or supporting documents transpire to be wrong, inaccurate, or otherwise misleading or deceptive, IMD may cancel Enrolment, exclude participation in the Program, and withdraw any award, certification, or degree. This shall also apply when failing to cite sources or using the work of others in your application. In such a case, no reimbursement of any fees (as detailed under Clause 2 (Fees, Costs and Expenses) of these Terms) shall be made. IMD reserves the right to claim compensation for any prejudice suffered.

2. FEES, COSTS AND EXPENSES

The following section outlines the payment terms that apply to the Programs, including the tuition fee for the Program you are enrolled in (the “Program Fee”).

Payment method: Payment of the Program Fee must be made using one of the following IMD-approved methods: (i) wire transfer to IMD’s designated bank account, (ii) the dedicated payment portal for Sprint Programs, or (iii) any other method expressly authorized by IMD. The applicable payment method will be specified in the relevant Program documentation or invoice. All costs or expenses associated with the chosen payment method, including but not limited to bank charges or transaction fees, shall be borne exclusively by you.

Payment timing: Except as specifically provided for with respect to IMD’s MBA and EMBA Programs (please refer to the specific additional terms for those programs) Program Fees must be paid in full within 30 days of invoice issuance and prior to the official start date of the relevant Program. In cases where registration occurs within one month of the Program’s initiation, immediate settlement of the invoice is mandatory, without exception. Specific deadlines and payment instructions will be communicated in the Program invoice or through the designated Program portal. Failure to meet the payment deadline may result in denied access or cancellation of Enrolment.

Non-payment: If payment of the applicable Program Fee (fully or for each invoice) is not received in accordance with the specified terms, IMD reserves the right to deny or revoke access to the Program platform, cancel Enrolment, or dismiss you from the Program. It may also lead to IMD withholding Program certification and/or revoking or suspending alumni status. These measures apply to all Program types.

VAT: Unless expressly stated otherwise, all fees are exclusive of any value-added tax (VAT), sales tax, or other indirect taxes that may be applicable in any jurisdiction. Participants are solely responsible for the payment of any such taxes.

Costs and expenses: Participants are solely responsible for all other costs incurred in connection with their participation in a Program. This includes, without limitation, expenses related to travel, accommodation (including any fees resulting from late cancellations, whether booked independently or through IMD), and participation in events, meetings, or conferences organized by IMD or held in the context of a Program. This also applies to any costs associated with applying to or being enrolled in a Program. Additionally, any expenses incurred as a member of the IMD alumni network are the sole responsibility of the alumni member.

3. ENROLLMENT AND ACCEPTANCE ON A PROGRAM
3.1. Acceptance

Should you be accepted by IMD as a Participant in a Program, IMD shall notify you by email. The email address we use is the one you provided us on your application. In such case, or if no suitable replacement Program is available, any Program Fee already paid shall be reimbursed in accordance with the IMD cancellation policy set out in Clause 3.4 below.

IT IS EXPRESSLY SPECIFIED AND UNDERLINED THAT THERE SHALL BE NO FURTHER RESPONSIBILITY FOR IMD FOLLOWING SUCH CANCELLATION OF A PROGRAM, INCLUDING, IF APPLICABLE, FOR ANY COSTS THAT YOU WOULD HAVE IN RELATION TO YOUR PARTICIPATION IN A PROGRAM SUCH AS TRAVEL OR ACCOMMODATION COSTS. PARTICIPANTS ARE ADVISED TO CONSIDER TRAVEL CANCELLATION INSURANCE.

Cancellation due to Violation of Terms: IMD reserves the right to cancel your Enrolment and dismiss you from the Program if you breach any of these Terms.
